OER E-Designation Program

Throughout New York’s 5 boroughs, the New York City Department of City Planning has placed environmental restrictions on certain properties and has been designated to have hazardous materials, noise, and/or air quality issues based on historical property usage.  

 

Properties that have been historically utilized as gas stations, dry cleaners, auto repair shops, and metal plating businesses are more likely to be designated with environmental restrictions.

 

The New York City Office of Environmental Remediation (NYCOER) oversees all E-designated sites and requires that investigation work plans, remedial investigation reports, remedial action work plans, and remedial closure reports be prepared and submitted for review and approval.

 

The NYC OER issues a notice to proceed following the review of the remedial action work plan. Then, they'll issue a notice of satisfaction after the completion of all remedial work.

 

The notice of satisfaction is forwarded to the New York City Department of Building for the issuance of a Certificate of Occupancy.
